Terms of Service Agreement

I understand participating in a BIKETERNITY, LLC tour is potentially hazardous. I reviewed, understand and agree to the following terms and conditions for my participation in a BIKETERNITY, LLC tour, and I understand that BIKETERNITY, LLC strongly suggests consulting a physician prior to participating in said BIKETERNITY, LLC tour. I will only participate in a tour if I am medically able to do so and I am properly trained.

I will undergo any prescribed medical treatment in the event of an accident or illness during an BIKETERNITY, LLC tour. I fully assume all risk of illness, injury, or death, and release and discharge BIKETERNITY, LLC and its employees, agents and assigns from all actions, claims, or demands for damages arising out of my participation in a BIKETERNITY, LLC tour.

The foregoing release shall be binding upon me, my heirs, executors/administrators, including my family members. To maximize the tour enjoyment for participants, BIKETERNITY, LLC reserves the right to deny a tour application and deny further participation during a tour if a participant’s actions are inappropriate and cannot be corrected. In exercising this right, BIKETERNITY, LLC will consider the following grounds, including but not limited to: inaccurate or incomplete application; physical inability to participate; inadequate equipment or training for the tour; unsatisfactory behavior which is dangerous, detrimental or otherwise interferes with the enjoyment of a tour group; expulsions or unjustified withdrawals from a prior tour.

BIKETERNITY, LLC will advise each applicant in writing within 15 days of receipt of an application whether it accepts the application. If a problem arises after
BIKETERNITY, LLC has accepted an application, the participant will have a reasonable opportunity to remedy the problem.
I agree to all conditions stated and will follow the instructions that BIKETERNITY, LLC will send to me upon acceptance of my application.

TRAVEL INSURANCE
Travel insurance is optional and available to cover some unforeseen cancellations or emergencies. BIKEternity, LLC sincerely wishes for every tour participant to attend and complete the tour. In an effort to plan for unexpected personal emergencies, health issues, weather, and transportation problems that might cause you to cancel or shorten your tour, travel insurance is strongly advised. You can compare the policies and prices of most major providers at www.insuremytrip.com. You should also check with your credit card company to see if they offer free travel insurance.

PHOTOTGRAPHY AND VIDEO
I understand that BIKETERNITY, LLC reserves the right to make photographic records of its tours, and I agree that, without compensation to me, BIKETERNITY, LLC may use such photographic records for promotional and commercial purposes.
This agreement shall be interpreted according to the laws of the State of Montana and is subject to binding arbitration under the Montana Uniform Arbitration Act. Venue for any court proceedings shall be the district courts of Missoula County, Missoula, Montana.

DISCLAIMERS

BIKEternity, LLC is an authorized permittee of Grand Teton National Park.

I read and understand BIKETERNITY, LLC’s policies, including those stated above, and agree to the terms and conditions stated in this agreement and in the Application. I agree that the terms of this agreement shall be binding on BIKETERNITY, LLC only if BIKETERNITY, LLC accepts my tour application.
